Staffing Standards Implemented for Nursing Homes Per the Final Rule Dated April 22, 2024 

 

CMS has solidified the Minimum Staffing Standards for Nursing Homes. The long-awaited final rule was published in the Federal Register on April 22, 2024.

The rule establishes a new requirement of:

 

  1. 3.48 HPRD (hours per resident day)  for Total Nurse Staffing (RNs, LPN,s, and Nurse Aides.) 
  2. 0.55 HPRD for Registered Nurses (RNs).
  3. 2.45 HPRD for Nurse Aides, i.e., Certified Nurse Assistants.
  4. On-Site Registered Nurse (RN) presence 24/7. 
  5. The implementation of these staffing standards will occur in phases:

 

Nursing homes in non-rural areas must adhere to the standards within two years for the 24/7 RN requirement and within three years for the RN and nurse aide HPRD requirements.

 

Nursing homes in rural areas have a timeline of three years for the 24/7 RN requirement and five years for the RN and nurse aide HPRD requirements.
